Is This the Death of Posse Comitatus?

The Pentagon is pushing for the authority to post 400,000 troops on the streets of America for active patrol in the event of an “emergency”. (The President will arbitrarily get to decide what qualifies as an “emergency”).

This would violate the Posse Comitatus Act. Many state governors rightfully oppose the idea as the latest assault on states rights. The ACLU is on the correct side of this one:

Mike German, the ACLU’s national security policy counsel, expressed amazement “that the military would propose such a broad set of authorities and potentially undermine a 100-year-old prohibition against the military in domestic law enforcement with no public debate and seemingly little understanding of the threat to democracy.”

There is a dangerous trend here with the recent pushes for martial law. Notice that the push for martial law is always coming from those in power, not those who would be subject to it.

New York Town Considers Martial Law; Troops Patrol in Alabama

It seems that the public is increasingly being acclimated to the idea of martial law–military troops domestically deployed on the streets of the U.S. (in violation of posse comitatus) acting as enforcers of the law. Recently Brian Stratton, the mayor of Schenectady, New York, announced that he may declare martial law in the wake of numerous police suspensions and terminations that have left the local department shorthanded:

SCHENECTADY, N.Y. — Schenectady Police Chief Mark Chaires said, “This is unprecedented – all these officers getting in trouble at the same time for all these different reasons.

Five Schenectady police officers recently accused of everything from driving drunk to beating up a man are leading city officials to look at taking drastic action to fix a department tainted by the few who may have acted illegally, like Darren Lawrence and Michael Brown who are accused of driving while intoxicated…

Currently, officials are reviewing the legal options and planning to present a full report in early April – options like a consolidated county-wide police force or bringing in the State Police.

The mayor said there is another option – and that would be declaring martial law. The governor would have to declare it and then the National Guard would come in. The mayor said it’s more for a transition to a new police force if that were to happen.

He said, “It may be that as a stopgap measure, that you would need military forces – State Police, National Guard.”

The Houston Chronicle (along with CNS and others) is reporting that an inquiry is underway into the possible (probable) violation of federal laws when military personnel assisted during the aftermath of a tragic mass shooting in Samson, Alabama. While the intentions of the military personnel involved were probably good, this sets a dangerous precedent and erodes the barrier posse comitatus is meant to provide against the improper and potentially tyrannical use of military forces.

Also, on the heels of the absurd and slanderous MIAC report, a document has surfaced that outlines the U.S. Army Reserve’s monitoring of recent “End the Fed” rallies accross the country.

Most people in the military are good (they contributed more money to Ron Paul during the elections than any other candidate!). Most police officers are good too. But the events outlined above only contribute to the erosion of trust, privacy, and liberty in this nation that began gradually years ago and now is only accelerating. Let’s hope it doesn’t continue.

Glorifying and Worshipping the Police State

Ah, yes. Homeland Security U.S.A. is the latest in mind-numbing “reality” television and it looks to be little more than propaganda for the state. Sit back, relax, and be acclimated to the incremental loss of your liberties in the comfort of your own home!

Just watch — all of these people in uniform are so nice and good and official looking! There is nothing to fear, we should give them more power to “do their jobs”. Pay no attention to the 20,000+ troops being stationed in America or the warrantless checkpoints because it’s all “for your safety” of course. Everything changed a few years ago (don’t you know?) — posse comitatus and the Bill of Rights are obsolete these days.

Ron Paul Endorses Chuck Baldwin for President

Ron Paul endorsed Chuck Baldwin of the Constitution Party for president in a letter titled “A New Alliance” posted on his Campaign for Liberty website earlier today.

There is a lot to admire about both Cynthia McKinney and Ralph Nadar, but Paul certainly picked the best candidate still running for office in Chuck Baldwin. It’s also kind of funny given what Bob Barr did recently that Paul decided to come out and endorse someone after all — someone besides “Bad Barr” that is. Take that Barr! Maybe the Libertarian Party will run someone decent next time.

The letter/press release from Ron Paul reads in part the following:

The Libertarian Party Candidate admonished me for “remaining neutral” in the presidential race and not stating whom I will vote for in November.   It’s true; I have done exactly that due to my respect and friendship and support from both the Constitution and Libertarian Party members.  I remain a lifetime member of the Libertarian Party and I’m a ten-term Republican Congressman.  It is not against the law to participate in more then one political party.  Chuck Baldwin has been a friend and was an active supporter in the presidential campaign.

I continue to wish the Libertarian and Constitution Parties well.  The more votes they get, the better.  I have attended Libertarian Party conventions frequently over the years.

In some states, one can be on the ballots of two parties, as they can in New York.  This is good and attacks the monopoly control of politics by Republicans and Democrats.  We need more states to permit this option.  This will be a good project for the Campaign for Liberty, along with the alliance we are building to change the process.

I’ve thought about the unsolicited advice from the Libertarian Party candidate, and he has convinced me to reject my neutral stance in the November election.  I’m supporting Chuck Baldwin, the Constitution Party candidate.

Police Trap Peaceful Protesters In Denver

Most of what I know about this incident is what’s shown in the video, but it seems pretty clear — police surrounded peaceful protesters in Denver and essentially trapped them, after which they moved in with batons and tear gassed them:

Cops Shoot Woman Twice, Laugh About It

A crowd of Miami storm troopers shot an unarmed woman — twice. Then they joked and laughed about it. They also referred to innocent citizens as “scurrying cockroaches”.

An innocent Ohio woman called 911 and was essentially gang raped (absent penetration) by a group of cops then left naked for hours in a jail cell; AKA “strip searched”.

Honest, good police deserve everyones respect for doing a difficult job. But there is a dangerous trend occurring in this country that only seems to be getting worse. More and more limits are being placed on our civil/Constitutional rights while our police forces are simultaneously becoming more militarized.

Pointless and often brutal police state tactics include the tasing of our fellow citizens at the drop of a hat, which have sometimes resulted in the death of the victims — er, I mean “suspects”. This is nothing less than an instant death penalty of sorts, but without formal charges or a trial. Sadly, these incidents may be only the beginning if this trend continues. If it can happen to these people, it can happen to any of us.
